Facts

The appellant [X.] was convicted by the District Court of Baden for a qualified violation of the Narcotics Act and sentenced to a partially suspended custodial sentence of 36 months. The High Court of the Canton of Aargau upheld the judgment and increased the sentence to 4 years' imprisonment. [X.] subsequently filed a complaint with the Federal Supreme Court.

Considerations

The Federal Supreme Court dealt with various complaints by the appellant, in particular regarding the admissibility of interrogations and evidence. It concluded that the factual allegations at the beginning of the interrogations were sufficiently concrete and that the prosecuting authorities were not obliged to disclose all their knowledge at the outset.

Furthermore, the Federal Supreme Court considered the transcripts of the monitored conversations to be admissible despite the lack of the case officer's signature, as this was merely a matter of procedural regulations. The failure to submit the audio recordings of the conversations also did not lead to their inadmissibility.
