Facts

The appellant [A.] was employed as a designer at [E. AG] . As part of a mass dismissal, she was dismissed in January 2017. She then filed a claim against [E. AG] for the payment of 17,000 Swiss francs net and default interest. During the ongoing proceedings, the District Court of Höfe opened bankruptcy proceedings against the legal successor of [E. AG] , [B. AG] . The proceedings were then converted into a collocation procedure. The District Court dismissed the claim, which was subsequently confirmed by the Cantonal Court of Schwyz.

[A.] appealed against this judgment to the Federal Supreme Court in civil matters. She requested the annulment of the judgment and the obligation of the bankruptcy estate of [B. AG] in liquidation to pay 17,000 Swiss francs net and default interest.

Considerations

The Federal Supreme Court did not enter into the appeal. It stated that the civil appeal was inadmissible, as the amount in dispute of 30,000 Swiss francs, which is decisive for collocation proceedings, was not reached. The appellant also did not demonstrate that there was a legal issue of fundamental importance that would justify an exception to the amount in dispute requirement.
