Facts
The appellant [A.] was found guilty by the Federal Criminal Court of criminal preparatory acts for a deprivation of liberty and kidnapping, as well as a violation of the Weapons Act. He was sentenced to a custodial sentence of 12 months and a measure pursuant to Art. 60 of the Swiss Criminal Code (SCC) was ordered.
On 11 February 2020, [A.] was on his way from Basel to Zurich, and then intended to travel to [V.] , with various items, including four unconventional explosive and incendiary devices, two daggers, and other equipment. The lower court assumed that [A.] wanted to "liberate" his children, who he believed were in [U.] in [V.] and from whom he lived separately, by means of a kidnapping or deprivation of liberty.
Considerations
The Federal Supreme Court considers the factual findings of the lower court and the legal assessment to be unobjectionable. It notes that [A.] systematically made technical and organizational arrangements, the nature and extent of which show that he was about to carry out a deprivation of liberty or kidnapping. This fulfilled the objective elements of Art. 260bis para. 1 lit. e SCC.
