Facts
The appellant [A.] was sentenced by the Higher Court of the Canton of Zurich to a custodial sentence of nine and a half years for violation and multiple qualified violations of the Narcotics Act as well as criminal preparatory acts for robbery. He filed a criminal law appeal against this judgment. The Federal Supreme Court partially annuls the higher court judgment and remands the case to the lower court for a new decision on the sentencing. In all other respects, the appeal is dismissed. The lower court had indeed described the duration of the proceedings as "excessively long" and granted the appellant a sentence reduction of five months. However, it neither found a violation of the requirement for expedited proceedings under Art. 5 CrimPC nor examined the mitigating circumstance pursuant to Art. 48(e) SCC. Thus, it violated its duty to provide reasons. The Federal Supreme Court remands the case to the lower court to supplement the reasoning on the sentencing.Considerations
