Facts

The appellant [A.] is the minor son of the unmarried parents [B.] and [C.] . After the dissolution of the common household in January 2019, [A.] requested the District Court of Rheinfelden to order [C.] to pay maintenance contributions. The District Court granted joint parental responsibility to both parents, placed the son under the sole care of the mother, and regulated the father's right of access. Furthermore, it obliged [C.] to pay cash and care maintenance.

Both [C.] and [A.] appealed to the High Court of the Canton of Aargau. The High Court partially upheld [C.] 's appeal and adjusted his right of access. In all other respects, it dismissed the appeals. It also adjusted the maintenance arrangement and obliged [C.] to pay monthly maintenance contributions in varying amounts.

Considerations

The Federal Court partially upholds the appeal of [A.] . It considers the full consideration of the tax burden of the opposing party [C.] in the maintenance calculation for the period from July 1, 2019 to November 30, 2019 to be contrary to federal law. Furthermore, the High Court violates federal law by limiting the surplus share of the appellant to a flat rate of CHF 375.-- per month, without providing sufficient reasons for doing so.
