Facts

The appellant [A.] is accused, among other things, of having committed sexual assaults on the then approximately 16-year-old [B.] and of having shown pornographic material to the minor [C.] . The High Court of the Canton of Zurich convicted him of sexual abuse and pornography and sentenced him to a custodial sentence of eleven years and eight months.

[A.] appeals in criminal matters and requests to be acquitted of the charges of sexual abuse and pornography. The lower court wrongly considered the statements of the opposing party [B.] to be credible, without ordering a professional assessment of her mental state. Furthermore, the proof of conditional intent in the charge of pornography has not been established.

Considerations

The Federal Supreme Court partially upholds the appeal

Regarding sexual abuse: The lower court did not arbitrarily assess the evidence of [B.] 's statements. An additional professional assessment was not mandatory.
