Facts
A., born in 1965, has been living with her life partner B. and partially six children in Zurich for over seven years. A. has been supported by the Social Services of the City of Zurich with interruptions since 1997 and again since May 2010. A contribution from her life partner was always taken into account in her support budget, most recently until April 2013 in the amount of CHF 1,548.40.
With the performance decision of April 17, 2013 for the period from May 1, 2013 to April 30, 2014, the cohabitation contribution was set at CHF 2,755.50. A. filed an objection against this decision, which was however rejected. Against the decision of the District Council, A. had a complaint filed and requested that the cohabitation contribution in the social assistance budget be reduced to CHF 1,300 per month.
Considerations
The Federal Supreme Court dismisses the complaint. It states that the consideration of a cohabitation contribution in the social assistance budget in the presence of a stable cohabitation is neither arbitrary nor a violation of the principle of equality before the law. It does not matter whether the capable cohabitation partner expressly declares himself willing to actually pay the contribution or not.
