Facts

A., born in 1977, receives a helplessness allowance for severe helplessness and lived with his parents, born in 1930 and 1933 respectively. In February 2013, he applied for an assistance allowance. The IV-Stelle Schwyz (Disability Insurance Office of the Canton of Schwyz) denied him an assistance allowance of an average of CHF 6,152.45 per month or a maximum of CHF 67,676.95 per year, effective from February 1, 2013.

A. filed a complaint against the decision. The Administrative Court of the Canton of Schwyz dismissed the complaint. A. then filed an appeal in public law matters with the Federal Supreme Court.

Considerations

The Federal Supreme Court decided that the recognized need for assistance for everyday activities, household management, social participation, and leisure activities amounts to 240 hours per month. No further assistance services under the Ordinance on Disability Insurance (IVV) are apparent.

The Federal Supreme Court confirmed that the time covered by the helplessness allowance and contributions from health insurance must be deducted from the recognized need for assistance. This results in a monthly assistance allowance of CHF 4,490.-.
