Facts
The Canton of St. Gallen appealed against the decision of the Administrative Court of the Canton of Thurgau, which confirmed the competence of the Canton of Thurgau for the financial social assistance to the sons A.A. and B.A. from April 1, 2019. The children were provisionally placed in foster care on November 30, 2018, with a simultaneous order for an assessment as a basis for the final decision on child protection measures.
The Child and Adult Protection Authority (KESB) deprived the parents of the right to determine the place of residence of the children and placed them in a children's home. On April 1, 2019, the mother moved her place of residence from the Canton of St. Gallen to the Canton of Thurgau.
Considerations
The Federal Supreme Court decided that it cannot be qualified as obviously incorrect that A.A. and B.A. were only considered "permanently not living with the parents or one parent" within the meaning of the Federal Act on Responsibility for the Assistance of Persons in Need (ZUG) from the main decision of the KESB of November 19, 2019. Together with the provisional foster care placement, an assessment was ordered as a basis for the final decision on the child protection measure.
