Facts

A.A. (plaintiff, appellant) and B. (defendant 2, respondent 1) as well as C. AG (defendant 1, respondent 2) are the owners of an agricultural business in U. and the associated properties in V. (hereinafter collectively referred to as: the C. farm). The C. farm originally belonged to D.A., the husband of A.A. Due to financial problems, B. granted a loan to D.A. and received a purchase option on the C. farm in return.

By a contribution in kind agreement dated March 2, 1988, D.A. sold the C. farm to the newly founded C. AG. On October 12, 1988, A.A., her husband, and B. jointly founded C. AG. On February 10, 1989, D.A. and B. concluded a pledge agreement, in which the pre-contract was declared null and void and it was stated that D.A. owed B. CHF 550,000, which B. had provided him to finance the composition agreement. To secure this debt, D.A. handed over all 50 shares of C. AG to B. as a pledge.

On January 3, 1995, B. and D.A. concluded a purchase agreement for all 50 shares of C. AG. On February 17, 1998, a capital increase of an additional 50 shares took place at C. AG. B. received 39 shares, D.A. 10 shares, and A.A. 1 share.

The C. farm was originally leased to D.A. After he reached retirement age, B. and C. AG leased the leased properties owned by them to A.A. with two separate lease agreements dated February 17, 1998. On March 5, 2011, A.A. as the tenant and B. as the landlord signed an "addendum to the lease agreement", in which they agreed that the lease would be limited until December 31, 2016.

By letter dated December 26, 2015, B. terminated the lease agreement as of December 31, 2016. He claimed that his son wanted to cultivate the C. farm in the future.

Considerations

The Federal Supreme Court overturned the judgment of the Cantonal Court, which had declared the nullity of the lease agreement dated March 5, 2011 and the termination dated December 26, 2015. It remanded the case regarding the extension of the lease to the Cantonal Court…
