Facts
[R.] submitted an application for unemployment benefits on June 27, 1996, requesting the allocation of benefits from the previous June 12. Invited by the Vaud Cantonal Public Unemployment Insurance Fund to provide proof of job search during this period, [R.] produced a medical certificate attesting to his incapacity to work.
The fund made two decisions on the case on September 3, 1996: it ordered a 15-day suspension of the right to benefits, payable from July 1, 1996, on the grounds that [R.] had violated his duty to provide information by failing to spontaneously report his incapacity to work. It also denied the right to unemployment benefits during the period from June 12 to June 30, 1996, on the grounds that the incapacity to work had been reported late and without valid excuse.
[R.] appealed to the Administrative Court of the Canton of Vaud, which reduced the duration of the suspension of the right to benefits from 15 to 10 days and rejected the appeal regarding the refusal of the right to benefits during the period from June 12 to June 30, 1996.
Considerations
The Federal Tribunal considers that [R.] did not report his incapacity to work to the administration within the one-week deadline provided for in Art. 42 para. 2 OACI and that he cannot claim a valid excuse to justify this delay. Therefore, the fund was entitled to refuse him the allocation of a daily allowance for the period from June 12 to June 30, 1996.
