The appellant [A.] received daily allowances from the Health Insurance Fund of Swiss Metal Construction Companies under the Health Insurance Act (HIA) from 17 August 2012. By decision of 31 March 2014, the health insurance fund discontinued the benefits as of the 1st of the month. [A.] filed an appeal against this decision, which the health insurance fund rejected with its appeal decision of 16 June 2014. The Social Insurance Court of the Canton of Zurich dismissed the appeal of [A.] against the appeal decision, as the appeal of 20 May 2014 had been filed too late. The Federal Supreme Court confirmed this decision.Considerations
The Federal Supreme Court stated that the time limit for filing an appeal under Art. 52 para. 1 GSSLA in conjunction with Art. 38 paras. 1 and 4 lit. a as well as Art. 39 GSSLA had expired on 16 May 2014.
