The appellant [S.] filed an appeal against a decision on objection of the Swiss Mobiliar Insurance Company dated 31 March 2008, which had discontinued the benefits of the accident insurance. The Social Insurance Court of the Canton of Zurich dismissed the appellant's request for restoration of the time limit for submitting a correct power of representation with a decision dated 30 June 2008 and, as threatened, did not enter into the appeal.Considerations
The Federal Supreme Court upheld the decision of the Social Insurance Court. It stated that the regulation on the restoration of time limits pursuant to Art. 41 GSSLA applies to the present proceedings. The time limit set by the Social Insurance Court for the submission of the power of representation expired on 26 May 2008.
