Facts

[X.] (Husband), born 1947, and [Y.] (Wife), born 1953, were married in 1994. The childless marriage was divorced on 7 June 2005. The District Court of Alttoggenburg-Wil regulated the ancillary consequences of the divorce, imposing on the Husband a maintenance obligation of CHF 1,000 per month for one year and a payment from the matrimonial property of CHF 54,552 to the Wife. Furthermore, a transfer of CHF 150,000 from the Husband's pension assets to the Wife's vested benefits account was ordered.

Both parties appealed against this decision. The St. Gallen Cantonal Court set the post-marital maintenance at CHF 1,650 for two years and subsequently at CHF 400 until the Wife reaches AHV retirement age. The Wife's claim under matrimonial property law was set at CHF 86,197.

The Husband appealed against this decision to the Federal Supreme Court. He requested that the maintenance contribution be set from July 2005 for two years and, alternatively, be completely waived. Furthermore, he demanded that the Wife's claim under matrimonial property law be reduced to CHF 10,000.

Considerations

The Federal Supreme Court dismissed the Husband's appeal. It held that the lower court had rightly assumed the Husband's claim for reimbursement of his separate property against his acquired property, as the origin of the funds for the life insurance premiums could no longer be proven.
