The estate community [C.] dec. consists of [B.] and [A.] . The community property includes 30 properties and other assets. In the course of several debt enforcement proceedings against [A.] , the debt collection office of the Seebezirk seized his liquidation shares in the community property for claims of ten creditors in the amount of a total of CHF 9'920.60. The Cantonal Court of Fribourg as the cantonal supervisory authority ordered the dissolution of the estate community [C.] dec. and instructed the debt collection office to apply to the competent peace court for the division of the inheritance.Considerations
The Federal Court dismissed the appeal of [A.] against the decision of the cantonal supervisory authority. It stated that the supervisory authority could order the dissolution of the estate community and the liquidation of the community property in accordance with the provisions applicable to the estate community, as the value of the appellant's share in the community property was not easily determinable under Art. 10 para. 2 DRJPO.
