Facts

A., born in 1953, had his widower's pension terminated by the Compensation Fund of Appenzell Outer Rhodes as of 30 November 2010, when his youngest daughter reached the age of 18. His appeals were dismissed by the Cantonal Court of Appenzell Outer Rhodes and the FSCA. Seized of an individual complaint, the ECHR found on 11 October 2022 that Switzerland had violated Article 14 in conjunction with Article 8 of the ECHR by its judgment of 4 May 2012. A. then filed a request for revision of this FSCA judgment.

Considerations

The FSCA considers that the request for revision has in part become moot. Indeed, the Swiss Confederation has declared itself ready to compensate A. in the amount of 63,847 francs (plus default interest as of 1 December 2012) corresponding to the pension benefits of which he was deprived. To the extent that A. does not substantially contest the calculation of this amount, the FSCA considers that the revision is not necessary to remedy the violation of the ECHR found by the ECHR.
