Facts
A., born in 1977, was employed as a machine operator for V. AG since 1 October 2004. Since a work accident on 17 January 2006, he could no longer perform this employment, which is why the company terminated the employment relationship as of 31 October 2006 by giving notice. A. registered with the Unemployment Insurance for job placement on 14 August 2007 and stated that he was willing and able to work part-time, at most to the extent of a 50% workload. The Cantonal Unemployment Insurance Fund of St. Gallen paid daily allowances based on a compensable loss of work of 50%. On 28 February 2008, A. informed that he would be discharged from his daily sickness allowance insurance on 17 March 2008 and requested an adjustment of the unemployment daily allowances. The Regional Employment Centre Sargans (RAV) then decided on 24 April 2008 that the compensable loss of work was still 50%. A. appealed against this decision.Considerations
According to Art. 15 para. 2 UIA in conjunction with Art. 15 para. 3 UIO, a disabled person who has registered with the Disability Insurance is considered employable until the decision of the Disability Insurance. The Unemployment Insurance is obliged to make advance payments during this time in order to avoid gaps in compensation. This means that A. is entitled to full unemployment compensation as long as he is looking for employment to the extent of the work capacity attested to him by a doctor and is willing to take up a new position with the corresponding workload. A reduction of the unemployment daily allowances would only be justified if A. were obviously not employable, which is not the case here.
