Facts

The complainant, [B.] , is the mother of a son born on 27 January 2008 and was employed in the bakery-confectionery business [X.] . She applied for benefits from the disability insurance on 1 February 2002 and received a half disability pension with effect from 1 March 2002, based on a 50% degree of disability, by decision of 12 May 2003. In the course of three ex officio revisions, the disability insurance office of the canton of Aargau confirmed the entitlement to a half pension. In March 2010, the complainant initiated another revision procedure, and the disability insurance office terminated the disability pension as of the end of July 2011.

The Social Insurance Court of the Canton of Aargau dismissed the complaint lodged against this decision. The complainant is now filing a complaint in public law matters and requests that she continue to receive the statutory disability pension.

Considerations

The Federal Court has correctly reproduced the relevant legal bases for the concept of incapacity for work, earning incapacity, and disability. It has also taken into account the provisions and principles for determining the degree of disability for gainfully employed insured persons using the general method of comparing income and the probative value and evaluation of medical reports and expert opinions.

The court has established that the notification of 23 December 2008, with which the disability insurance office confirmed the entitlement to a half pension, was not based on a substantive review of the pension claim. At that time, the disability insurance office had relied solely on the progress reports of the insured's general practitioner, which showed a slightly improved or stable state of health, but did not conduct a comprehensive review of the health and economic circumstances.
