Facts

The complainant, [L.] , applied for benefits from the disability insurance on 29 October 2001. The Bern disability insurance office granted her a full pension as of 1 April 2003, a half-pension as of 1 August 2003, and a quarter-pension as of 1 March 2004, by decision of 2 June 2005. Upon appeal by the insured person, it set the start of the full pension at 1 November 2001 and acknowledged the claim for a supplementary pension for the spouse (decision of 1 November 2005). [L.] appealed against this decision, requesting that the appeal decision be revoked insofar as it reduced the full pension with effect from 1 August 2003, and that the disability insurance office be required to pay her a pension with an invalidity degree exceeding 66 ²/3 % even after 31 July 2003.

The Administrative Court of the Canton of Bern upheld the appeal insofar as it found that [L.] was entitled to a three-quarter pension for January and February 2004, and as it revoked the reduction to a quarter-pension as of 1 March 2004 and referred the case back to the disability insurance office for further clarification and subsequent issuance of a new decision; it dismissed the appeal in all other respects.

Considerations

The Federal Court had to decide whether the contested decision of the Administrative Court of the Canton of Bern was a partial decision or an interim decision. It concluded that the decision regarding the pension claim for the period from 1 August 2003 to 29 February 2004 was a partial decision that could be appealed independently.
