Facts
The [X. AG] , a corporation registered in the commercial register of the canton of Basel-Landschaft, concluded financing and leasing contracts for vehicles, ships, and industrial goods. Since January 1, 1995, it had been registered in the register for VAT-liable persons. The Federal Tax Administration conducted an audit at the taxpayer from May to June 1999, which could only be completed in July 2000. Based on the deficiencies found, it demanded with supplementary invoice of July 14, 2000, for the period from January 1, 1995, to March 31, 2000, VAT in the amount of CHF 423,725.-- plus default interest of 5% as of July 1, 1998 (medium-term maturity).
The [X. AG] contested the supplementary invoice, and the Federal Tax Administration made a formal decision on October 23, 2002, confirming the tax claim of CHF 423,725.--. The [X. AG] appealed against this decision, which was rejected on June 11, 2003. The [X. AG] then turned to the Federal Tax Appeals Commission, which dismissed the appeal on June 16, 2005.
By administrative court appeal of July 7, 2005, the [X. AG] requests the Federal Court to repeal the decision of the Federal Tax Appeals Commission of June 16, 2005.
Considerations
The Federal Court has dismissed the appeal of the [X. AG] against the decision of the Federal Tax Appeals Commission of June 16, 2005. The appellant was entitled to appeal under Art. 103 lit. a FJA, and the appeal was filed in due form and time.
The Federal Court has found that the accounting of the appellant with regard to VAT shows significant deficiencies. The appellant has only inadequately fulfilled its statutory recording and accounting obligations under Art. 47 VATO. The discretionary assessment made by the Federal Tax Administration is therefore not objectionable.
The appellant has not shown that the…
