Art. 5 PatA

1 Der Patentbewerber hat dem IGE den Erfinder schriftlich zu nennen.
2 Die vom Patentbewerber genannte Person wird im Patentregister, in der Veröffentlichung des Patentgesuchs und der Patenterteilung sowie in der Patentschrift als Erfinder aufgeführt.
3 Abs. 2 ist entsprechend anwendbar, wenn ein Dritter ein vollstreckbares Urteil vorlegt, aus welchem hervorgeht, dass nicht die vom Patentbewerber genannte Person, sondern der Dritte der Erfinder ist.
