Facts
The appellant [A.] was criminally prosecuted by the Public Prosecutor's Office of Basel-Landschaft for a qualified violation of the Narcotics Act. In the context of this proceeding, a total of 23 secret surveillance measures were ordered and approved by the Compulsory Measures Court of the Canton of Basel-Landschaft. [A.] filed an appeal against these orders and approvals with the Cantonal Court of Basel-Landschaft. However, the Cantonal Court did not enter into the appeal, as it did not meet the requirements for reasoning under Art. 385 para. 1 CCP.
[A.] filed an appeal in criminal matters against the non-entry decision of the Cantonal Court with the Federal Supreme Court. He requested that the decision be set aside and the matter be remanded to the Cantonal Court for a substantive assessment. Alternatively, he requested that the substantive legal requests made in the previous instance proceedings be granted.
Considerations
The Federal Supreme Court dismissed the appeal, insofar as it was to be entered into. It stated that the appellant's appeal to the Cantonal Court did not meet the requirements for reasoning under Art. 385 para. 1 CCP. The appellant had merely made general complaints, without specifically addressing the contested decisions and their considerations or showing in what respect they were incorrect.
