Facts
The Zurich-Sihl Public Prosecutor's Office initiated criminal proceedings against the complainant [A.] for false accusation, allowing a vehicle to be used by a person not authorized to drive, and disregarding a court order. On April 17, 2019, it summoned him to appear on June 5, 2019. As [A.] did not follow the summons, the Public Prosecutor's Office issued an order for his police escort on June 5, 2019, to be carried out on June 13, 2019. [A.] was arrested by the Cantonal Police of Appenzell Ausserrhoden on June 12, 2019, and questioned by the Public Prosecutor's Office from 8:03 a.m. to 10:42 a.m. on June 13, 2019. The High Court of the Canton of Zurich partially upheld a complaint filed by [A.] and found that the order for police escort dated June 5, 2019, was disproportionate.
Considerations
The Federal Supreme Court stated that the requirements for a police escort under Art. 205 para. 4 and Art. 207 of the Swiss Criminal Procedure Code (StPO) were met. [A.] had failed to comply with the summons of April 17, 2019, without justification and had also announced that he would not comply with future summons. Thus, the legal requirements for an escort were given.
