Facts

The Federal Prosecutor's Office is conducting a criminal investigation against the Gambian national [A.] on suspicion of crimes against humanity. [A.] was arrested in Switzerland on 26 January 2017 and placed in pre-trial detention on 28 January 2017. The detention has since been extended repeatedly.

The Compulsory Measures Court granted the application. [A.] 's appeal against this decision was dismissed by the Federal Criminal Court (Appeals Chamber) on 4 September 2019.

[A.] is now appealing in criminal matters, requesting that the decision of the Federal Criminal Court be overturned and that he be released immediately.

Considerations

The Federal Supreme Court affirmed the strong suspicion of guilt against [A.] , as there are concrete indications that as a former Interior Minister of Gambia, he was responsible for torture by police forces, prison staff, and groups close to them. The lower court has convincingly justified the strong suspicion of guilt by referring to further evidence such as witness statements and the evaluation of the appellant's documents.
