Facts
A., born in 1974, registered with the employment office on March 6, 2003. She stated that she had last worked at company C. from November 1, 2001 to June 30, 2002, and at company E. from January 1 to June 30, 2002. The unemployment insurance fund set the insured earnings at CHF 1,000, as no actual wage payment had been proven beyond the CHF 1,000 received from company E. A. filed an objection, whereupon the unemployment insurance fund denied the entitlement to unemployment compensation as of March 6, 2003 due to the lack of contributory employment.
A.'s appeal was dismissed by the Administrative Court of the Canton of Zug. A. then filed an administrative court appeal with the aim of affirming her entitlement to unemployment compensation and setting the insured earnings at CHF 3,600.
Considerations
The Federal Supreme Court states that for the entitlement to unemployment compensation, the exercise of contributory employment for at least six months is the only decisive factor. Proof of actual wage payment is not an independent requirement for entitlement, but can be a significant indication of the exercise of contributory employment.
