D.X. (born 1916) is the husband of C.X. and the father of son B.X. From his first marriage, he has two daughters, F. and G. D.X. is the majority shareholder and Chairman of the Board of X. Holding AG and its subsidiaries, while C.X. is the sole managing director. On April 3, 2006, D.X. granted a general power of attorney to attorney R. and his daughter F. Since April 6, 2006, the X. spouses have been living separately.
C.X. applied to the guardianship authority of the municipality of W. for urgent guardianship measures to protect D.X., as he was no longer competent to judge due to a dementia disorder and was being massively manipulated. The guardianship authority and the district council rejected the application, whereupon C.X. and B.X. filed a complaint with the High Court of the Canton of Zurich.
