Facts

A., born in 1963, had been employed as a laboratory technician at Heart Center B. since 1994 and was insured with Helsana Accident Insurance AG against the consequences of accidents and occupational diseases. On August 10, 1997, she injured her left foot in a riding accident. Helsana then provided daily allowances and covered the medical treatment. In June 2006, it was determined that her condition had stabilized and a 25% integrity compensation was paid.

On December 15, 2010, A. reported a relapse and claimed a massive increase in complaints in the midfoot, ankle, and forefoot. Helsana then provided insurance benefits again, including the costs for medically prescribed orthopedic shoes and physiotherapy. However, in November 2015, Helsana determined that the medical final condition had been reached and there was no longer any entitlement to further treatment or aids and appliances.

The Federal Supreme Court states that aids and appliances such as orthopedic shoes are not covered by the entitlement to medical treatment under Art. 19 para. 1 sentence 2 of the Accident Insurance Act (UVG). The entitlement to aids and appliances therefore continues to exist even after case closure, provided the requirements of Art. 11 UVG are met.
