Facts

The late E. passed away on June 1, 2004, leaving her four children A., B., C. and D. as her legal heirs. By a holographic will dated October 20, 1986, the deceased favored her daughter A. to the detriment of her three sons. The estate consisted mainly of three agricultural parcels located in the municipality of G., as well as various bank assets. A.'s husband, F., had already purchased the agricultural business "W." from his father-in-law on October 27, 1980. On January 13, 1999, F. and A. concluded a marriage contract by authentic deed, abolishing their previous matrimonial regime (participation in acquisitions) and establishing a regime of general community of property. According to this contract, in the event of the dissolution of the co-ownership of the agricultural business "W.", the co-owner F. (the husband) could demand that the business be allocated to him, by derogation from Art. 36 RLRA. On June 10, 2005, A. (the appellant) filed an action against her three co-heirs (the respondents) to establish the composition of the estate and the shares of the inheritance, as well as to obtain the allocation of the three agricultural parcels and the determination of their yield value. In the second cantonal instance, her request for allocation of the agricultural parcels was rejected. Before the Federal Tribunal, the appellant renews her request for allocation of the agricultural parcels at double the yield value.

The properties must also be located within the usual operating area of this business. 2.4.2 Co-ownership of an agricultural business is equated with ownership within the meaning of Art. 21(1) RLRA, provided that the legal position of the co-owner is of a lasting nature and comparable to that of a sole owner. However, the mere fact of being a co-owner with one's spouse of an…
