Facts
Michael Ulrich, born in 1970, was supported by the Compensation Fund of the Canton of Schwyz with medical measures to treat his congenital disability (congenital amblyopia) in 1979. In March 1980, the Fund revoked this decision within the framework of a reconsideration, which was confirmed by the Administrative Court of the Canton of Schwyz in September 1980.
In December 1980, Ulrich's father re-registered him with the Disability Insurance, whereupon the Compensation Fund decided in December 1980 not to enter into the request. This decision was confirmed by the Administrative Court of the Canton of Schwyz in February 1981.
Ulrich filed an administrative court appeal against this decision with the Federal Insurance Court, requesting that the Disability Insurance cover the treatment of his eye condition.
Considerations
The Federal Insurance Court states that it can only examine whether the administration was right not to enter into the new registration of December 1980. A review of the substantive aspects of the dispute is not possible.
The administration was not obliged to reconsider the decision of March 1980, as it had been reviewed and confirmed by the Administrative Court. There was also no reason to enter into the new registration for procedural revision reasons, as no new facts or evidence were presented.
