Facts

The Public Prosecutor's Office of the Canton of Basel-Stadt fined [X.] with a criminal order dated 1 September 2015 with CHF 220.-- for a simple violation of traffic regulations (Art. 90 para. 1 RTA), namely:
  • Exceeding the speed limit in the 30 km/h zone by 4 km/h with a Hyundai passenger car on 6 April 2014,
  • Parking within the signposted parking prohibition with a Hyundai passenger car on 9 April 2014,
  • Parking within the signposted parking prohibition with a Renault passenger car on 9 October 2014,
  • Parking in a meeting zone at a non-designated location with a Hyundai passenger car on 1 November 2014.
Both passenger cars were marked with the identical license plate yyy. [X.] was held liable as the owner of the vehicles in accordance with Art. 6 FixPenA.

Considerations
