Facts
The bankruptcy estate of X. (the plaintiff) brought an action against Y. AG (the defendant) to obtain payment of an amount of 35'383.50 CHF with interest at 5% since July 15, 2003. The plaintiff argued that X.'s estate had been opened to bankruptcy and that the deceased had operated a dental practice in which A. was employed. After the opening of the bankruptcy, the bankruptcy administration decided to continue operating the dental practice and authorized A. to organize and manage the continuation of the operation. A. was instructed to pay only the necessary expenses for the continuation of the operation and not to pay pre-bankruptcy claims. However, A. paid the defendant an amount of 35'383.50 CHF for services provided before the opening of the bankruptcy. The defendant requested the dismissal of the claim.
The Aarau district court granted the claim, but the Argovia cantonal court of appeal overturned this judgment and dismissed the claim. The plaintiff appealed to the Federal Court.
Considerations
The Federal Court examined the question of whether the bankruptcy estate had a claim for restitution of unjust enrichment against the defendant due to the payment of a claim before the final distribution schedule. The Federal Court considered that, before the opening of the bankruptcy, there was a legal relationship between the deceased and the defendant, and that the defendant's claim was based on services provided before the opening of the bankruptcy.
The Federal Court also examined the effects of the opening of the bankruptcy on the claims of creditors and considered that the opening of the bankruptcy did not change the legal situation between the debtor and the creditor. The Federal Court also considered that the defendant had not been enriched without cause, as the claim was based on services provided before the opening of the bankruptcy.
