Facts
The appellant, a Czech citizen, entered Switzerland in 2008 and was granted an EU/EFTA residence permit. After her separation from her life partner, she was supported by social welfare and later received supplementary benefits. The Migration Office of the Canton of Basel-Stadt refused to renew her residence permit and expelled her from Switzerland.
The appellant applied for renewal of her residence permit and claimed that she had sufficient financial means and was not dependent on social welfare. The Appellate Court of the Canton of Basel-Stadt, acting as an administrative court, dismissed her appeal.
The appellant appealed to the Federal Supreme Court and requested that the judgment of the Appellate Court be set aside. She claimed that the non-renewal of her EU/EFTA residence permit constituted a violation of Art. 2 AFMP (non-discrimination) and Art. 8 para. 2 Cst. (prohibition of discrimination).
Considerations
The Federal Supreme Court examined its jurisdiction and the admissibility requirements and concluded that the appeal was admissible. The appellant complained of a violation of Art. 2 AFMP in conjunction with Art. 2 para. 2 FNIA and claimed that the receipt of supplementary benefits under national law did not lead to the revocation of the residence permit.
The Federal Supreme Court dismissed this complaint and decided that the previous instance's application of Art. 24 para. 1 Annex I AFMP was not objectionable. The receipt of supplementary benefits was equivalent to the receipt of social welfare, and the appellant did not have sufficient financial means to support herself.
