Facts

The appellant, a taxi driver, was checked by the cantonal police on October 19, 2014, and a drug rapid test was carried out, which was positive. A blood and urine sample was taken and the driver's license was provisionally withdrawn. The analysis revealed that the appellant was under the influence of amphetamines and cannabinoids. The cantonal road traffic commission ordered the precautionary withdrawal of the driver's license for an indefinite period and ordered a traffic-medical fitness to drive report.

The appellant lodged a complaint against the decision of the cantonal road traffic commission and requested the cancellation of the precautionary withdrawal and the return of his driver's license. The Cantonal Court of the Canton of Fribourg, III. Administrative Court, dismissed the complaint.

Against the judgment of the Cantonal Court, the appellant lodged a complaint with the Federal Court. He requests the cancellation of the contested decision and the return of his driver's license.

Considerations

The Federal Court examined the complaint and came to the conclusion that the lower court had rightly ordered the precautionary withdrawal of the driver's license. The appellant had already been convicted once for driving under the influence of drugs and there were indications of possible addictive behavior.

The Federal Court found that the finding of the cantonal authorities, according to which the appellant had driven a vehicle under the influence of drugs on October 19, 2014, was not arbitrary. Although the measured values for amphetamines and cannabinoids were below the legal limits, the combined consumption of amphetamines and cannabinoids could mutually enhance the drug effect and impair fitness to drive.
