Art. 799 CC

1 Das Grundpfand entsteht unter Vorbehalt der gesetzlichen Ausnahmen mit der Eintragung in das Grundbuch.
2 Das Rechtsgeschäft auf Errichtung eines Grundpfandes bedarf zu seiner Gültigkeit der öffentlichen Beurkundung.
