A. AG, B. AG, and D. AG are the owners of various parcels within the "Baggersee" perimeter of the municipality of Raron. The municipality of Raron planned to designate a special agricultural zone within this perimeter for a cow wrestling arena and a farmers' market of the Upper Valais Chamber of Agriculture.
The owners filed an objection against the detailed land use plan "Baggersee" that provided for this special agricultural zone. The municipal council rejected the objections, whereupon the owners filed an administrative appeal with the State Council and later a public law appeal with the Federal Supreme Court.
Considerations
The Federal Supreme Court decided that the designation of the special agricultural zone for the planned cow wrestling arena and farmers' market is not permissible:
- The Canton of Valais has not made any positive or negative site planning for special agricultural zones in the cantonal structure plan, nor has it issued any requirements for their designation by the municipalities. Therefore, no special agricultural zones can currently be designated in accordance with Art. 16a para. 3 of the Spatial Planning Act and Art. 38 of the Spatial Planning Ordinance.
