Dismissal of the Appeal against Payment Orders

Facts

[A.] filed an appeal against payment orders issued by the Debt Collection Office of Basel-City against him. The lower and upper supervisory authorities dismissed the appeal. Against this, [A.] filed an appeal with the Federal Supreme Court.

Considerations

The Federal Supreme Court dismissed the appeal, insofar as it was admissible. It stated that the claim for a declaratory judgment regarding alleged organizational deficiencies of the Debt Collection Office was inadmissible, as the general official activities are not the subject of an appeal under Art. 17 et seq. DEBA.
