Facts
On 27 December 2018, the Regional Prosecutor's Office Oberland decided not to initiate criminal proceedings against [X.] for defamation or calumny. The complainant [A.] then filed a complaint against this decision. The High Court of the Canton of Bern dismissed the complaint on 8 February 2019.
[A.] now appeals in criminal matters to the Federal Supreme Court. He requests that the case be remanded to the lower instance for re-examination to determine whether [X.] or other legal entities have committed coercion or other offences subject to ex officio prosecution. Furthermore, he seeks to ensure the safeguarding of his civil claims for damages and satisfaction.
Considerations
The Federal Supreme Court considers the decision not to open proceedings as lawful. The Prosecutor's Office was entitled to discontinue the proceedings against [X.] , as there were no concrete indications of a criminal offence. The statements of the second respondent to the landlord merely represented the complainant's suspicion, which did not justify the opening of criminal proceedings.
