The municipality of Ausserferrera planned the construction of a forestry road from the cantonal road to the alpine pasture "Lavenzug" to develop the forest area east of the cantonal road. The Graubünden Nature Conservation Association Pro Natura Graubünden filed an objection to the project. The Administrative Court of the Canton of Graubünden dismissed the appeal. Thereupon, Pro Natura Schweiz - Swiss Association for Nature Conservation filed an administrative court appeal to the Federal Supreme Court.Considerations
The Federal Supreme Court overturned the decision of the Administrative Court and referred the matter back to the Administrative Court for re-evaluation. The court justified this by stating that the competent authorities had not sufficiently clarified the facts and had carried out an incomplete weighing of interests.
