Company X. AG is the owner of a plot of land (parcel no. 3524) in Obfelden, for which there is a suspicion of a contaminated site. The Canton of Zurich is the owner of the adjacent parcel no. 3525, which is also suspected of being contaminated. In 2002, the canton ordered company X. AG to conduct a detailed investigation of its land. The company appealed against this decision, which was ultimately brought before the Federal Tribunal.Considerations
