Facts

The [X. AG] had obtained a payment order of CHF 590.-- against the Canton of Schwyz from the Debt Enforcement Office of Schwyz. The Canton of Schwyz lodged an objection and the [X. AG] requested definitive debt enforcement. The District Court of Schwyz dismissed the application and imposed court costs of CHF 150.-- on both parties, each to pay half. The Canton of Schwyz appealed against this ruling to the Cantonal Court of Schwyz and requested that the court fee be borne in full by the [X. AG] or the District of Schwyz and that it be awarded appropriate compensation. The Cantonal Court upheld the appeal, imposed the court fee half each on the [X. AG] and the District of Schwyz, and awarded the Canton of Schwyz party compensation of CHF 400.--.

The [X. AG] has lodged a complaint with the Federal Court against the cantonal court's decision and essentially requests that the cost and compensation consequences of the debt enforcement and cantonal appeal proceedings be allocated according to the outcome.

Considerations

The Federal Court accepts the submission of the [X. AG] as a subsidiary constitutional complaint, since the amount in dispute does not reach the statutory minimum of CHF 30,000.-- and the complainant does not raise a legal issue of fundamental importance.

The cantonal court upheld the appeal by the Canton of Schwyz against the cost and compensation consequences of the debt enforcement proceedings and imposed the court costs of the first-instance proceedings of CHF 150.-- half each on the creditor and the District of Schwyz. Furthermore, it awarded the Canton of Schwyz party compensation of CHF 400.-- for both instances.

The Federal Court is of the opinion that the cantonal court has arbitrarily regulated the cost consequences of the cantonal appeal proceedings by providing that the costs are to be borne by the complainant according to the outcome. A…
