Art. 110 CO

Eintritt eines Dritten

Soweit ein Dritter den Gläubiger befriedigt, gehen dessen Rechte von Gesetzes wegen auf ihn über: 1. wenn er eine für eine fremde Schuld verpfändete Sache einlöst, an der ihm das Eigentum oder ein beschränktes dingliches Recht zusteht; 2. wenn der Schuldner dem Gläubiger anzeigt, dass der Zahlende an die Stelle des Gläubigers treten soll.
