Art. 216 CO

Formvorschriften

1 Kaufverträge, die ein Grundstück zum Gegenstande haben, bedürfen zu ihrer Gültigkeit der öffentlichen Beurkundung.
2 Vorverträge sowie Verträge, die ein Vorkaufs-, Kaufs- oder Rückkaufsrecht an einem Grundstück begründen, bedürfen zu ihrer Gültigkeit der öffentlichen Beurkundung.
3 Vorkaufsverträge, die den Kaufpreis nicht zum voraus bestimmen, sind in schriftlicher Form gültig.
