Art. 437 CO

Meldet der Kommissionär in den Fällen, wo der Eintritt als Eigenhändler zugestanden ist, die Ausführung des Auftrages, ohne eine andere Person als Käufer oder Verkäufer namhaft zu machen, so ist anzunehmen, dass er selbst die Verpflichtung eines Käufers oder Verkäufers auf sich genommen habe.
