Art. 69 CO

1 Der Gläubiger braucht eine Teilzahlung nicht anzunehmen, wenn die gesamte Schuld feststeht und fällig ist.
2 Will der Gläubiger eine Teilzahlung annehmen, so kann der Schuldner die Zahlung des von ihm anerkannten Teiles der Schuld nicht verweigern.
