Art. 71 CO

Bestimmung nach der Gattung

1 Ist die geschuldete Sache nur der Gattung nach bestimmt, so steht dem Schuldner die Auswahl zu, insofern sich aus dem Rechtsverhältnis nicht etwas anderes ergibt.
2 Er darf jedoch nicht eine Sache unter mittlerer Qualität anbieten.
