Art. 91 RTA

1 Mit Busse wird bestraft, wer:
  1. a. in angetrunkenem Zustand ein Motorfahrzeug führt;
  2. b. das Verbot, unter Alkoholeinfluss zu fahren, missachtet;
  3. c. in fahrunfähigem Zustand ein motorloses Fahrzeug führt.
2 Mit Freiheitsstrafe bis zu drei Jahren oder Geldstrafe wird bestraft, wer:
  1. a. in angetrunkenem Zustand mit qualifizierter Atemalkohol- oder Blutalkoholkonzentration ein Motorfahrzeug führt;
  2. b. aus anderen Gründen fahrunfähig ist und ein Motorfahrzeug führt.
