Art. 147 CPC

Säumnis und Säumnisfolgen

1 Eine Partei ist säumig, wenn sie eine Prozesshandlung nicht fristgerecht vornimmt oder zu einem Termin nicht erscheint.
2 Das Verfahren wird ohne die versäumte Handlung weitergeführt, sofern das Gesetz nichts anderes bestimmt.
3 Das Gericht weist die Parteien auf die Säumnisfolgen hin.
