Art. 345 CPC

Schadenersatz und Umwandlung in Geld

1 Die obsiegende Partei kann verlangen:
  1. a. Schadenersatz, wenn die unterlegene Partei den gerichtlichen Anordnungen nicht nachkommt;
  2. b. die Umwandlung der geschuldeten Leistung in eine Geldleistung.
2 Das Vollstreckungsgericht setzt den entsprechenden Betrag fest.
