Facts
The appellant [A.] had been in criminal proceedings custody since August 4, 2014. On December 8, 2014, the public prosecutor's office brought charges against him for multiple rape, possible indecency, simple bodily harm, attempted coercion, threats, and physical assault against his life partner [B.] . The Baden District Court acquitted [A.] of guilt and punishment on April 15, 2015. The public prosecutor's office then applied for the continuation of precautionary detention, which was approved by the Aargau Cantonal Court on April 17, 2015.
[A.] filed a complaint in criminal matters with the Federal Court, requesting that the Cantonal Court's ruling be repealed and that he be released from custody immediately. The Cantonal Court and the public prosecutor's office applied for the complaint to be dismissed.
Considerations
The Federal Court upheld the complaint and repealed the Cantonal Court's ruling. The Federal Court also found that the lower court should have served the public prosecutor's application for continuation of precautionary detention to the appellant with a short, non-extendable deadline for comment…
